Track Waiver - EXAMPLE

RELEASE AND INDEMNIFICATION

Being an experienced/or inexperienced motocross rider, I recognize and understand that motorcycles, because of their power, size, and speed, can be extremely dangerous machines, and therefore, riding motocross tracks is an inherently perilous activity, which poses a very real potential for severe human injury and/or death.

Being aware of these hazards, it remains my desire to utilize the motocross track on Robert and Susan Wise private property located at 9091 Ellsworth/Atwood Rd. Charlevoix, MI.

As consideration for the use by me, of the motocross track and property, I AGREE TO ACCEPT AND ASSUME ALL, (100%), OF THE RISK INVOLVED IN THIS ACTIVITY, and in doing so specifically acquit, relieve, exempt, and release Robert and Susan Wise from any and all claims for injury or accident or damages sustained or occasioned by this activity, whether due to my own negligence or the negligence of Robert and Susan Wise.

I also indemnify, hold harmless, and accept all responsibility, and will defend Robert and Susan Wise from any and all negligence by me in connection with this track activity.

I further represent that I have attained the age of eighteen, (18), years, and am under no legal disability which would prevent me from executing this release.

Each rider must be equipped with:

• BOOTS
• CHEST PROTECTER
• HELMET/GOGGLES
• RIDING SHIRT AND PANTS
• KIDNEY BELT
• GLOVES
